E-FARMASI PHARMACISTS/PHYSICIANS
Your use of e-farmasi may involve contact with an e-farmasi pharmacist or other pharmasicts or physicians. The pharmasicts and physicians of e-Farmasi will not give medical advice; rather they will help you find answers to your health-related questions. You agree that contact with a pharmacist or physician on e-Farmasi will NOT create any relationship including but not limited to a pharrmacist/physician-patient relationship. GS Vision encourages users to maintain their current relationships with their own personal pharmacists/physicians. The interaction with e-farmasi pharmacists/physicians is not intended to be used as a substitute to the personal, hands-on treatment your personal pharmacist/physician can provide which is assumed to involve some knowledge of your personal medical history. Accordingly e-farmasi pharmacists/physicians will not diagnose, treat, or prescribe medication, prescription or otherwise to users of this site. E-Farmasi will not keep medical records, however GS Vision reserves the right to record the dialogue contained within the public chat areas or the pharmicist/doctor-hosted discussions with one or more members using e-farmasi.
GS Vision encourages you to refrain from disclosing personal information of a kind you would wish to be kept confidential. Pharmacists/physicians registered on e-Farmasi will NOT enter a "pharmacist/doctor-patient" relationship with users and thereby will not consider personal medical information , which is provided by users, as part of any type of permanent "medical record."
GS Vision encourages you to send questions to the registered pharmacists via Email. The pharmacist will not provide diagnoses or treatment or prescribe medication. Actual diagnosis, treatment, and medication prescriptions should be obtained solely from your own personal physician.
USER SUBMISSIONS.
You agree that you will not upload or transmit any communications or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this Site, you agree that such submission is non-confidential for all purposes. If you make any such submission, you automatically grant--or warrant that the owner of such content has expressly granted—GS Vision and e-Farmasi a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed.
RULES GOVERNING E-FARMASI LIVE CHAT , MEMBER TO MEMBER OR ASK THE PHARMACIST AREAS ("PUBLIC AREAS")
If through e-Farmasi you use a Public Area, you agree that you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in these Public Areas. You agree that e-Farmasi is NOT responsible for the consequences of communications in any Public Area. If you feel threatened or believe someone else is in danger, you should immediately contact your local law enforcement agency. If you have a medical emergency, call 994 or your doctor immediately. In consideration of the being allowed to use the Public Areas on this Site you agree that any of the following actions will constitute a material breech of these terms and conditions of use.
1.Using a Public Area for any purpose in violation of any state, federal or international laws.
2.Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others.
3.Posting advertisements or solicitations of business.
4.After receiving a warning, continuing to disrupt the normal flow of dialogue or posting comments or materials that are offensive, unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by GS Vision in its sole discretion;.
5.Posting chain letters, pyramid schemes or posting the same note repeatedly or"spamming."
6.Impersonating another person.
7.Harvesting or otherwise collecting information about other
users, including email addresses, without their consent.
8. Introduction of or distributing viruses or other harmful computer codes
9.Engaging in conduct that restricts or inhibits others from public areas of the site or exposes others or e-Farmasi, in the judgement of e-Farmasi, to any liability or detriment of any kind.
10.Allowing any other person or entity to use your identification for posting or viewing comments;
Reservation of specific rights
e-Farmasi reserves the right to do any of the following with respect to protecting the integrity of the Public Areas:
1.Record the dialogue between members in the public chat rooms or more specifically between participants in the pharmacist-hosted sessions in public chat rooms or in one on one pharmacist/member sessions.
2.Remove communications, which are abusive, illegal, or disruptive , or otherwise fail to conform to these Terms and Conditions.
3. Terminate a user's access to any or all Public Areas and/or the E-Farmasi Site upon any breach of these Terms and Conditions.
4.Monitor, edit, or disclose any communication in the Public Areas.
5.Edit or delete any communication(s) posted on the E-Farmasi Site, regardless of whether such communication(s) violate these standards.
INVENTORISED PRODUCTS
(1) GS Vision Sd Bhd and e-Farmasi assumes no liabilities for the use of any products supplied by any of the registered pharmacies hosted by e-Farmasi. You agree that you purchase the products supplied by any of the registered pharmacies hosted by e-Farmasi at your own risk. You agree that it is your responsibility to use them under the guidance of a physician/pharmacist.
(2) GS Vision Sd Bhd and e-Farmasi takes no responsibility for confirming the medical requirements or regulations affecting you. All products are couriered, delivered or shipped at your risk.
(3) You agree that, in the event the requested products are detained and confiscated by foreign customs, the loss lies completely with you.
(4) You agree that GS Vision Sd Bhd and e-Farmasi shall not, under any circumstances, be responsible for damaged or out-dated products purchased by you from the registered pharmacies hosted by e-Farmasi.
(5) You agree and are aware that prices of products featured on the website are subject to change at the discretion of the registered pharmacies without further notice.
(6) You agree that availability of products is subject to change without further notice.
(7) You agree that GS Vision Sd Bhd and e-Farmasi is not responsible for delays caused by temporary delays in the delivery of the requested product/products from the registered pharmacists or by any other delays caused by third party.
(8) You agree that under no circumstances will GS Vision Sd Bhd and e-Farmasi be responsible for the delivery or sale of the wrong products by any registered pharmacist to you.
RESERVATION OF RIGHTS
GS Vision reserves the right (but is not obligated) to do any or all of the following:
1. GS Vision reserves the right to take any action it deems necessary to protect the personal safety of our visitors or the public.
2. GS Vision has no liability or responsibility to users of the E-Farmasi Site or any other person or entity for performance or non-performance of the aforementioned activities.
TRANSFER OF RIGHTS
GS Vision may sublicense its rights through multiple tiers of sublicenses.

GS Vision does not endorse the content on any third-party websites. INDEMNITY.
You agree to defend, indemnify, and hold GS Vision, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
ACCRUED RIGHTS
You agree that all rights reserved by or to GS Vision in these Terms and Conditions shall be deemed to be reserved with the same force and effect by its officers, directors, employees, associates, agents, licensors and suppliers (if any) as appropriate.
JURISDICTION.
You expressly agree that exclusive jurisdiction for any dispute with GS Vision, or in any way relating to your use of the e-Farmasi Site, resides in the courts of Malaysia and you further agree and expressly consent to the exercise of jurisdiction in the courts of Malaysia in connection with any such dispute including any claim involving
GS Vision or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.
TRADEMARKS
e-Farmasi is a trademark of GS Vision. All other brands and product names are trademarks or registered trademarks of their respective companies.
EXCLUSION CLAUSE
Nothing included in the pages of this Site should be construed as creating an pharmacist/doctor- patient relationship nor shall anything in this Site be deemed the provision of medical advice or a medical opinion.
WARNINGS
You are deemed to be aware of all Warnings found on this Site and have agreed to observe the Warnings strictly.
INVALIDITY
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
